Fax Machines – Technical Background & Applications

Fax machines remain relevant in German business despite e-mail: fax is recognised as text form under § 126b BGB and accepted by many authorities and courts. Laser fax (ITU-T T.30, V.34, up to 33,600 bps) delivers sharp documents and is suited for higher volumes; thermal fax is more compact but paper fades over time. Multifunction fax devices combine printer, scanner and copier in one unit (all-in-one) and are particularly economical for small offices. LAN fax servers send and receive faxes centrally and distribute them as e-mail (fax-to-mail, mail-to-fax) – manufacturers such as Panasonic offer corresponding network fax models. In an all-IP environment, an ATA adapter can emulate the analogue fax connection; for more reliable transmission, T.38 (Fax over IP) is recommended.

▶ Does a fax machine still work on an all-IP network?
Analogue fax machines can operate via an ATA adapter on the IP router, but with limitations: VoIP compresses voice data (G.711 codec recommended), which can cause transmission errors. More reliable is the T.38 protocol (Fax-over-IP, store-and-forward), supported by IP-capable fax machines and SIP trunks. Alternatively, a fax-to-mail service is recommended.
▶ Does fax have legal validity in Germany?
Yes. In Germany, fax is considered text form under § 126b BGB and is therefore usable for all legal transactions requiring text form (but not written form with handwritten signature under § 126 BGB). Authorities, courts and lawyers frequently accept fax as a legally valid transmission medium. For higher requirements (e.g. qualified electronic signature), other means are required.
▶ What is the difference between laser and thermal fax?
Laser fax prints with toner on plain paper – sharp, permanently archivable, higher print costs. Suitable for medium to high fax volumes. Thermal fax uses heat-sensitive paper, is more compact and cheaper to purchase, but: thermal paper fades within 5–10 years and cannot be archived. For document archiving and legally secure filing, we recommend laser fax or direct digital storage via fax-to-mail.
